Privacy Policy (Safe Harbor)

Scope:
Rolta Incorporated provides information technology services to customers in the United States. ROLTA’s customers do business and therefore may collect personal information from the European Union (“EU”). This privacy policy sets forth the steps that ROLTA takes to protect individually identifiable information obtained from the EU. This policy covers ROLTA and applies to all individually identifiable information that ROLTA may access or have access to while providing remote database administration services for a customer.
ROLTA protects individually identifiable information as follows:
Definitions
Personal data –
Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity
Processor –
A natural or legal person, public authority, agency or any other body which processes personal data on behalf of the controller
Controller –
The natural or legal person, public authority, agency or any other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of processing are determined by national or Community laws or regulations, the controller or the specific criteria for his nomination may be designated by national or Community law.
Disclosure:
ROLTA will not sell, trade, or disclose to third parties any Personal Information, derived from the use of any ROLTA service, (except as required by subpoena, search warrant or other legal process). When ROLTA uses other agents, contractors or companies to perform services on its behalf, ROLTA will ensure that the company protects the individually identifiable information in accordance with this policy
Security:
ROLTA has implemented technology and security features reasonably necessary to safeguard the Personal Information from unauthorized access or improper use.
Safe Harbor:
The United State Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (FAQ) to enable U.S. companies to satisfy European Union (EU) law requirements for adequate protection of personal information transferred from the EEA to the United States. ROLTA adheres to the Safe Harbor Principles outlined below.
Privacy Principles:
The privacy principles in this policy are based on the Safe Harbor principles agreed to by the EU and the US Department of Commerce.
Notice and Choice:
ROLTA does not collect personal information directly from individuals in the EU. Personal information may exist in databases of ROLTA’s remote database administration services customers. To the extent permitted in the Safe Harbor Agreement, we reserve the right to process personal information in the course of providing remote database administration services to our customers without the knowledge of individuals involved.
Data Integrity:
ROLTA will use personal information contained in its customers databases only for the purpose of providing services to its customers and only in ways that are compatible with the purposes for which it was collected.
Onward Transfers and Disclosures to Agents:
ROLTA will not knowingly disclose an individual’s personal information to third parties, except when one or more of the following conditions is true:
- The disclosure is required by law.
- The disclosure is requested by its customer and ROLTA is assured by the customer that the individual whose information is being disclosed has consented to the disclosure.
Enforcement:
ROLTA utilizes the self-assessment approach to assure its compliance with our privacy statement. ROLTA annually audits its procedures in order to verify that the processes are in conformance with the Safe Harbor Principles.
Changes in Practices:
ROLTA will keep this policy current and will inform you via its website of any changes that we make.
